Netflix vs. GoTV: Federal Appeals Court Overturns $2.5M Patent Verdict

In a major victory for the streaming industry, the U.S. Court of Appeals for the Federal Circuit has overturned a multi-million-dollar patent verdict against Netflix, ruling that the technology claimed by GoTV Streaming, LLC was never eligible for patent protection in the first place. The decision, issued on February 9, 2026, ends a long-running legal dispute and wipes out a previous $2.5 million jury award in GoTV’s favor, meaning Netflix will not owe any damages.

GoTV’s lawsuit centered on three patents related to how servers deliver video content to different wireless devices. The claimed invention focused on using a “generic template” that could be customized into device-specific commands so content would display properly on phones and tablets with varying screen sizes and capabilities. While this approach may sound technical, the appellate court concluded that it amounted to an abstract idea rather than a true technological innovation.

Applying the Supreme Court’s two-step test for patent eligibility, the judges found that GoTV’s patents merely described the age-old concept of customizing a product to fit a user’s needs, comparable to a tailor adjusting a dress pattern or a contractor modifying a blueprint. The court emphasized that implementing this concept using ordinary computers and networks does not transform it into a patentable invention, especially where there is no new hardware or improvement in how computers themselves function.

Although the court acknowledged that GoTV’s patent claims were sufficiently clear (reversing earlier findings that parts were indefinite), it ultimately ruled the patents invalid. As a result, other issues, such as induced infringement and damages, were rendered moot. The decision reinforces a growing legal trend: broad digital processes carried out on standard technology face increasing scrutiny. For companies innovating in tech and media, the case underscores a critical lesson, efficiency alone is not enough; true patent protection requires genuine technological innovation.
